1. Intellectual Property

• All materials, content, and resources provided through Bar Exam Academy, including but not limited to videos, visuals, question banks, practice exams, feedback documents, and coaching content, are the intellectual property of Bar Exam Academy. These materials are protected by copyright and other intellectual property laws.
• Students are granted a non-exclusive, non-transferable license to use these materials for personal study and exam preparation only. Unauthorised reproduction, distribution, modification, or use of our materials for any commercial or non-commercial purpose is strictly prohibited.
• Any attempt to share, publish, or otherwise distribute Bar Exam Academy’s materials without express written permission constitutes a breach of these terms and will be treated as a violation of intellectual property rights.

2. User Conduct

• Users agree to access and use Bar Exam Academy’s content solely for their personal and non-commercial purposes. Sharing login information, screen-sharing sessions, or publicly disclosing course content or other resources is prohibited.
• Any breach of these terms, including but not limited to unauthorised sharing or distribution of materials, will be treated as a serious infringement and may result in legal action.

3. Reporting of Breaches

• Bar Exam Academy reserves the right to take necessary steps to protect its intellectual property. In cases of unauthorised use, distribution, or sharing of materials, Bar Exam Academy may report the breach to relevant authorities, including the Legal Services Board of Victoria (LSBC), for investigation and action as appropriate.
• Breaches of these terms and unauthorised sharing of materials may also lead to suspension or termination of access to all Bar Exam Academy resources without refund.

4. Termination of Access

• Bar Exam Academy reserves the right to suspend or terminate access to course materials and resources in cases where terms are breached without notice and without refund.
• Users who are found to be in violation of these terms may be subject to further legal action and reporting to LSBC, where it is deemed necessary.

5. Cancellation Policy

Enrollees are permitted to cancel their enrollment within three (3) days from the initial enrollment date. In the event of cancellation within this period, a pro-rata refund will be issued. The refund amount will be calculated based on the extent of access to course materials and resources up to the date of cancellation. Please note that an administrative fee of no more than 10% of the fee paid may be deducted from the refund. Refunds will be processed within fourteen (14) business days of receiving the cancellation request.

By enrolling in Bar Exam Academy and accessing our resources, you agree to uphold these terms and conditions. Protecting the integrity of our course allows us to continue providing high-quality resources to future barristers.

6. Disclaimer of Liability

The Bar Exam Academy Course materials are provided solely for educational purposes and do not constitute a legal retainer or legal advice. The materials are prepared on a best-effort basis, and the responsibility for passing the exam rests solely with the student. To the fullest extent permissible by law, Bar Exam Academy will not be liable for any loss, injury, claim, liability, or damage of any kind arising in any way from a) Any disruptions or technical difficulties encountered with the Bar Exam Academy Course learning platform; b) Any delays, interruptions, or changes in the scheduling of webinars, practice exams, feedback, or individualised sessions, or adjustments in the timing of material releases; c) The accuracy, completeness, or any errors or omissions within the materials, or any services offered through the Bar Exam Course; d) Any use of the Bar Exam Course materials by you.

In the case of any damages, Bar Exam Course’s liability is limited to your actual direct damages or the amount paid for services, whichever is less. Bar Exam Course is not liable for any indirect, incidental, or consequential damages.
